Losing Licence

    This morning I got a call from the Cop who visited me in bed from my bike crash almost 3 months ago.. Anyhows he called me and told me that his boss wants to take away my licence, unless I said that i was tierd and ill just get a fine for neglent driving.. So i thought i just pay the fine, anyhows I call him to ask how many points i be losing.. from what im aware of L platers in sydney have only 2 points.. and that neglent driving fine costs 3 points and $170.. so either way im losing my licence.. which really shits me.. since i dont even know wot happen and they dont 2...

    any ideas if what they are doing is reasonable? i may have to fight it in court but to be honest... i dont wanna waste so much money to fight it.. and just pay and do my Ls again i guess..

    i tried to fight a couple of driving charges i had,
    but u can't beat the police,
    it was a waste of time and money!!

    Well Dean that really rips ya nightie dosnt it. THe **** finally hit the fan.

    What ya gotta do is the same thing u gotta do at school to beable to beat up the fat bullie (unless u were him). U have to train by this I mean do some home work find out if you have a case against them. See if they can fine you for somthing that the know nothing about. Remember the police are there to protect use not stab us in the back so fight bro!!!!!!

    Go to a lawyer and ask for some advice, it would be alot cheaper than losing ya licence and $170 thats for sure bro. You are aloud to ask the police what info they have to hold against u.

    I had a case where I was driving me car and went around a corner normally. Well this lady went into the police station and said I just about hit a guy on a bike. So they rang me at work and said they are taking me to court for dangours driving so then I went nuts. I asked questions like this.... Got proof??, got more than one witness?, Does she remeber who was driving?? Is she sertain that there was abike??? Did she talk to the guy on the bike?? and things like that and seen as the cops didnt have any witness' or solid proof they droped the charges (after calling me names of course) and every thing was sweet.

    One thing cops love ( i know this as my brother is one) they love people that dont stand up for them selfs. Talk is cheap and thats all they are doing.

    Thanks guys, Im going see what im going do once i receive the fine in the mail... most likely take it to court .. damn farkers!

    Cool Dean, hope you murder them like the pigs they are. There are a few good cops but about 75% of all the ones ive meet are assholes.     I'm really curious - how can they charge you with anything? No-one saw the accident, and no one knows why it really occurred (including yourself). There could easily have been something on the road, or your mates that you were riding with indicated that a van was going down the road in the opposite direction (and perhaps it crossed the lane and you had no choice but to swerve / lose control).

    There are too many other factors that could have occurred (including gravel or wet patch) that would warrant this.

    Anyhow - I have tried to find how many points l platers have in NSW but with no luck. In Victoria when I asked before I was told that l platers have the full 12, but it is at teh descretion of the police to take your license (permit) away at any time.

    ??? CRAZY !!!

    The people that picked him up to take him to the Hospitial told the cops. Boz they dont have any real evidence BUT there at the 'law' so therefor they twist it which way they want to.

    i seriouslly couldnt bother with them... if they take my licence so let it be.. i just get it again later.. i dont have much time since i work and study.. and i dont wanna waste no money takin it to court.. so just goin wait n see wot happens.. hopefully i dont lose my licence.. maybe they have the heart to decide not 2. . who knows hehe.

    When on your L's in NSW, you have no points scheme at all!! (For both car and bike). It just depends on how bad the infringement is.

    I beleive they compare it to how many points you would have lost if you were on a Provisional or full licence. So if the accident is worth three points demerit, they usually say loss of licence.

    I believe the Police tried to help you to lesson the charge when they gave you the 'plead Fatigue' case. Thus you may have a good chance of beating the charge. You just have to support your argument, and convince them that you are a good rider.

    I hope you dont have a bad car licence record!!!!

    This is the New Drivers handbook, it has it in there somewhere about the points scheme. According to the RTA it covers riders as well.

    Thanks for the info, I ranged the RTA and they advised that the police issue the fine and that the RTA decide if they take my licence away.. they told me that i shouldnt get my licence taken away since i have no records and this was the first time it has happen.. so, so far so good no letters yet so should be all good. <!-- s:cool: --><img src="{SMILIES_PATH}/icon_cool.gif" alt=":cool:" title="Cool" /><!-- s:cool: -->
